This Privacy Policy takes into account Swiss data protection law and, where applicable, the European Union General Data Protection Regulation (“GDPR”).

2. DATA WE PROCESS

Depending on how you use our website or services, we may process the following categories of personal data in particular:

  • first and last name;
  • billing and delivery address;

  • telephone number;
  • company information;
  • VAT number where provided;
  • information relating to orders and purchases;
  • products ordered;
  • delivery information;
  • history of communications with our customer service;
  • information relating to repair or warranty requests;
  • IP address;
  • technical information relating to browser and device;
  • information about use of the website;
  • language preferences;
  • customer account identifiers;
  • data required for fraud prevention and security;
  • payment information provided by payment service providers.

We do not necessarily store all sensitive card payment data ourselves. Such data may be processed directly by the relevant payment service providers.

5. ORDERS AND WOOCOMMERCE

Our store uses WooCommerce.

When an order is placed, the information required to fulfil it is stored in our shop system.

This information may include your contact details, delivery address, products ordered, amounts, taxes, shipping method, payment method and order status.

Data required for accounting and business records is retained for the period required by applicable law. In Switzerland, accounting records generally have to be retained for ten years.

6. PAYMENTS

Depending on the payment method selected, certain data is transmitted to a payment service provider.

We currently use in particular:

PostFinance Checkout

When payment is made through PostFinance Checkout, the information required to process and secure the payment is transmitted to the entities and service providers involved in the transaction.

WooPayments / Stripe

WooPayments relies in part on Stripe’s payment infrastructure.

Data required for payments, fraud prevention and compliance with regulatory obligations may be processed by WooPayments, Automattic, Stripe or their service providers.

Inmotion-Suisse does not necessarily receive the full payment card number.

7. DELIVERY AND LOGISTICS PARTNERS

To deliver an order, we transmit the necessary delivery data to the relevant carrier, supplier or logistics partner.

Depending on product availability, an order may also be shipped directly by a commercial partner located in Switzerland or the European Union.

In that case, the information strictly necessary for shipment, in particular name, address, telephone number or email address where required, may be transmitted to the partner responsible for delivery.

8. CUSTOMER SERVICE, WARRANTY AND REPAIRS

When you contact us or provide a product for diagnosis or repair, we may retain the information required to handle the case, including your contact details, communications, serial number, product information, diagnosis, photographs and service history.

This data is retained for as long as necessary to handle the request, provide follow-up and comply with legal obligations.

9. CUSTOMER ACCOUNTS

When a customer account is created, we retain the information required for the account to function and to display order history.

You may change certain information directly from your account.

You may request deletion of your account, subject to data that we must retain for legal, tax, accounting, contractual or security reasons.

10. COOKIES AND SIMILAR TECHNOLOGIES

Our website uses cookies and similar technologies.

Certain cookies are technically necessary for operation of the store, shopping cart, customer account, language selection and consent management.

Other technologies, in particular statistical or marketing technologies, are used only in accordance with applicable legal requirements.

11. COMPLIANZ

We use Complianz to manage consent preferences relating to cookies and similar technologies.

Complianz may store certain information locally in order to remember your consent choices.

12. JETPACK AND AUTOMATTIC

We use certain Jetpack features and Automattic services, including for technical functions, security, statistics or website administration.

Depending on the feature used, certain technical data, including IP address, browser information or information relating to use of the website, may be processed by Automattic.

Non-essential functions are, where required, subject to the user’s consent preferences.

13. GOOGLE ANALYTICS, GOOGLE TAG MANAGER AND GOOGLE SERVICES

Where these services are activated with the required consent, we may use Google services to measure use of our website and the effectiveness of our campaigns.

Information such as pages visited, interactions, technical device data and online identifiers may then be processed.

Technologies subject to consent may only be activated after the corresponding choice by the user where applicable law requires this.

14. AKISMET

We may use Akismet to detect unwanted comments or other abusive content.

The data required for this detection may be processed by Automattic in accordance with the terms applicable to the service.

15. WPML

We use WPML to provide our website in several languages.

Functional cookies may be used, in particular, to remember the selected language.

16. SOCIAL-MEDIA CONTENT AND LINKS

Our website may contain links or, depending on the page, embedded content from services including:

  • Instagram / Meta;
  • YouTube / Google.

A simple external link normally transmits data to the relevant network only when you open it.

Embedded content, however, may allow the relevant provider to receive technical data, including your IP address, when the content is loaded or activated.

Where consent is legally required, such content is blocked until consent has been obtained.

17. RECIPIENTS OF DATA

Depending on the circumstances, data may be transmitted in particular:

  • to our authorised employees;
  • to IT and hosting service providers;
  • to payment service providers;
  • to carriers;
  • to suppliers or partners responsible for direct shipment;
  • to statistics, security or marketing service providers;
  • to authorities where we are legally required to do so.

We do not sell our customers’ personal data.

18. INTERNATIONAL DATA TRANSFERS

In connection with operation of the website and the services used, certain data may be processed in Switzerland, the European Economic Area or other countries, including the United States.

Where data is transferred to a country that does not provide a level of protection recognised as adequate under applicable law, we use, where required, appropriate safeguards, including standard contractual clauses or another recognised legal mechanism.

International service providers may also process data in different data centres according to their own infrastructure.

  • data relating to orders and accounting records is generally retained for at least ten years where Swiss law requires this;
  • customer-account data is retained for as long as the account exists, subject to data that must be retained longer;
  • service, warranty or repair requests are retained for as long as necessary to follow the case and any possible claims;
  • cookie retention periods are stated in the Cookie Policy.

20. SECURITY

We implement reasonable technical and organisational measures to protect data against loss, unauthorised access, misuse, alteration or unauthorised disclosure.

No transmission of data over the Internet can, however, be guaranteed to be absolutely secure.

21. RIGHTS OF DATA SUBJECTS

Within the limits provided by applicable law, you may in particular request:

  • whether we process data concerning you;
  • access to your data;
  • correction of inaccurate data;
  • deletion of data;
  • restriction of certain processing;
  • delivery or portability of data where this right applies;
  • withdrawal of consent for the future;
  • or objection to certain processing where permitted by law.

Withdrawal of consent does not affect the lawfulness of processing carried out before withdrawal.
